Terms and Conditions
This document sets out the terms of participation in ABC Delicious magazine “ Cook and the Chef Prize Pack” competition (the “Competition”).
1. The Promoter of the Competition is the Australian Broadcasting Corporation (the “Promoter”) (ABN 524 292 78345), 700 Harris Street, Ultimo, New South Wales, Australia.
2. Entry to the Competition is open to all Australian residents. An entrant must be an individual and not a company or organisation. Entrants under 18 years of age need to obtain the consent of their parent or guardian to enter. Employees of the Promoter, or any person associated with the Competition and their immediate families, or any organisation or individual associated with the provision of the prize(s) are not eligible to enter.
3. Each entry must be entered in accordance with these Terms and Conditions. By entering the Competition, each entrant agrees to be bound by these Terms and Conditions. The Promoter may in its discretion refuse to award any prize to any entrant who fails to comply with these Terms and Conditions. All relevant instructions in the Promoter’s magazine form part of these Terms and Conditions.
4. Entry into the Competition is via SMS only. SMS costs 55c (including GST) per SMS message sent.
5. The Competition opens at 10am AEST on Wednesday 17th June 2009 and closes at 6pm AEST on 21st July 2009 (“Competition Period”). Any entry received before the commencement or after the expiry of the Competition Period will be deemed invalid. No responsibility is accepted for late, lost, delayed or misdirected entries.
6. To enter the Competition, you must:
(i) Tell us “which song gets you in the mood for food and why?” (“Food Mood Song”); and
(ii) submit Food Mood Song via SMS to 1999 5888.
7. Each entry must not exceed 160 characters in length or it will be deemed invalid.
8. Each entry must include your name or it will be deemed invalid. Each entry does not require your address, email and/or telephone number. Each entrant must be contactable on the mobile phone number used to enter the Competition.
9. Each entrant must not enter the Competition more than once.
10. SMS entry is available to residents of all Australian States and Territories. Please note that only the Telstra, Vodafone, Optus, Virgin Mobile and 3 networks facilitate entry to the Competition via SMS.
11. By submitting Food Mood Song to the Promoter, you grant the Promoter and its licensees and assignees a non-exclusive licence to exercise all rights in perpetuity throughout the world in Food Mood Song and all other material provided by you to the Promoter at any time pursuant to this Competition.
12. Without limiting the rights granted to the Promoter under point 11, you specifically agree that point 11 grants to the Promoter the following non-exclusive rights throughout the world:
(i) the right in perpetuity to communicate Food Mood Song to the public by any media; and
(ii) the right to promote Food Mood Song by any media,
and you grant to the Promoter all associated rights necessary to exercise the above rights.
13. The five (5) entrants whose Food Mood Song is judged by the Promoter’s judge to be the five (5) best, most original and creative will win the prizes (“Prize Winners”).
14. Chance plays no part in determining the Prize Winners.
15. The Prize Winners will each receive a Cook and the Chef Prize Pack valued at $A89.85 (including GST). The total maximum prize pool of the Competition is valued at A$449.25 (including GST).
16. The Promoter accepts no responsibility for any variation in prize value.
17. No component of the prize can be transferred or redeemed for cash. In the event that any of the prizes become unavailable due to circumstances beyond the Promoter’s control, the Promoter reserves the right to provide a similar product to the same or greater value as the original prize, subject to any applicable laws or written directions made under applicable legislation.
18. You warrant that:
(i) all details provided with your entry are true and accurate; and
(ii) the exercise of the rights granted to the Promoter in these Terms and Conditions will not infringe the rights of any third parties;
and you will indemnify the Promoter against any loss or damage resulting from any breach of these warranties.
19. You acknowledge that the Promoter is under no obligation to exercise any of the rights granted to it by these Terms and Conditions, and communicating Food Mood Song to the public by the Promoter is at the complete discretion of the Promoter.
20. You agree that the Promoter may use your entry and any personal details provided to the Promoter for any promotional, marketing and publicity purposes of the Promoter in any media without notice and without any fee paid to you.
21. Decisions of the Promoter and its panel of judges are final and will be binding on each person who enters the Competition and no correspondence will be entered into. Entries will be judged and Prize Winners announced on 27th July 2009. The Prize Winners will be notified via mobile phone. Please allow at least 28 days from the date of notification for the delivery of the prize.
22. In the event that a Prize Winner is unable to be contacted, the Promoter will retain the prize for three (3) months from the date of the judges’ decision. If any prize is not claimed within three (3) months of the date of the judges’ decision, the judges may determine another winner for the unclaimed prize. A winner of any unclaimed prize will be a Prize Winner for the purpose of these Terms and Conditions and the Competition.
23. If there is any event that prevents or hinders the Promoter’s conduct of the Competition or the Promoter’s ability to deliver the prizes to the Prize Winners of the Competition, the Promoter may, in its discretion, cancel the Competition and recommence it at another time under the same conditions or select another winner.
24. The Promoter is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error that may occur in the course of the administration of this Competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
25. To the full extent permitted by the law, the Promoter will not be liable for any injury, damages, expenses, or loss whatsoever (whether direct or inconsequential) to persons or property as a result of any person entering into the Competition or accepting or using any prize, including without limitation non-receipt of any prize or damage to any prize in transit.

TERMS AND CONDITIONS
1. Information on how to enter the draws and win prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is open to Australian residents aged 18 years or over who is a valid and current subscriber to delicious magazine during the Entry Period. Employees of News Magazines Pty Limited their advertising agencies, newsagents, subagents, respective employees and their immediate families are ineligible to enter.
3. This competition commences 21st July 2009 23:59 and ends 22nd July 2009 00:01 (Entry Period). All times are AEST or AEDST, whichever is applicable in NSW.
4. Winners will be drawn on Friday 24th July 2009 11:00am at Salmat Interactive, Innovation Place, Level 17, 100 Arthur Street North Sydney, NSW 2060.
5. Winners will be notified within 7 days of the draw. Winners will be notified in writing by mail, and the winners will be published on www.deliciousmagazine.com.au and in The Australian on Thursday 30th July 2009.
6. The Promoter’s decision is final and no correspondence will be entered into.
7. There are 2 the Kitchen essential packs from Pyrex to be won valued at $307.95 each. Total prize pool is $615.90
8. Only one prize will be awarded per person excluding SA.
9. Where the Promoter will take all care in the delivery of prizes, once the prize has left the Promoter’s premises they are not responsible for any late or damaged prizes. It is the entrant’s responsibility to advise the Promoter of any changes of personal details.
10. If a prize is unclaimed an unclaimed prize draw will take place on Friday 29th October 2009 at 11am at the same place as the original draw.
11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process (including but not limited to using automated means to enter). Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
12. Prize is not refundable, non-endorsable or non-transferable.
13. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
14. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
15. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) use of any prize.
16. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
